Which texts we checked
In the documentary check on 31 October 2026, the BOE provides the consolidated text of Royal Decree 579/2017, with its latest update published on 17 January 2024. It regulates aspects of manufacture, presentation and marketing within its scope. Law 28/2005 also contains provisions on devices capable of releasing nicotine and similar products; the consolidated version consulted indicates an update dated 18 November 2017.
These references locate the national framework consulted, but do not make this guide an exhaustive inventory of every obligation. Other rules and territorial scope may matter in a particular case. A responsible reading first identifies the activity being examined: manufacture, sale, advertising, use in a particular space or waste management.
An official document can still be a proposal
Spain’s Ministry of Health published a preliminary bill amending Law 28/2005 that was opened to public consultation in September 2025. The document itself identifies that stage. Being hosted on an official website makes it valuable as a source about the proposal, but does not, on its own, turn its contents into an obligation already in force.
When reading a story based on that document, look for whether it cites a subsequently published provision and the date of entry into force it establishes. The preliminary bill should not be used as standalone evidence that every measure described already applies. Nor should approval of one procedural step be confused with completion of the whole process.
The headline date is not enough
A story published today may summarise an earlier text. A published rule may include deadlines or transitional provisions. That is why the publication date, entry into force and the point from which each obligation applies need to be distinguished. The useful detail lies in the text and its timing provisions, not only beside the headline.
Also check which products the measure covers. A device, refill container, nicotine-containing liquid and other presentations may be defined differently. A colloquial word such as vape makes conversation easier, but a rule needs precise categories. Losing that precision can wrongly expand or narrow the scope of a news story.
A short record for following any change
Keep the official link, full name of the provision, its status, relevant date and the article affecting the question. Then compare that information with the news story’s claim. If you cannot find the published rule supporting an alleged current ban, verification remains open. This method helps you follow real changes without turning announcements, drafts or rumours into a definitive legal answer.
Take this with you
To establish what applies, check the published text, scope and application date; a preliminary bill is not enough.
